General Data Protection Regulation

Privacy Notice

CPRA is a limited company residents association not linked with any other company or with any business organisation and not conducting any business or commercial activities. This privacy notice states the legal basis for CPRA to hold and use information about you and explains how we use any personal information we collect about you when you agree to become a member of CPRA, which you can do by paying the subscription.

We collect and use information about you on the legal basis that doing so is within the purposes of our legitimate interests which do not infringe your interests and rights, and we comply with data protection laws.

What information do we collect about you?

When you agree to become a member of CPRA we ask for your first names, surname, postal address, email address(es), land-line (and if you wish mobile) phone numbers plus (if you wish) names of family members living with you at the same address.

How do we use the information about you?

The sort of things we will tell you about are; events taking place, unwelcome activities (e.g.theft and attempted theft from homes, gardens and out-buildings and suspicious people seen in the area), requests to help find lost property, activities organised by the Cricket and Tennis clubs, Planning Applications and building work in which we think you may have an interest or about trees on or near your property.

We will not share your information with anyone for marketing or any other purpose except as required by law or for fraud prevention.

We will keep your personal information until we learn that you no longer live on Chelsfield Park Estate or, if non-resident, until you cease to represent a sports club on the Management Council.

We will keep information relating to building works and removal of trees on your property indefinitely.

Access to your information and correction.

You have the right to request a copy of the information we hold about you. If you would like a copy of some or all your information please email or write to us c/o the Secretary at the address given at the end of this notice.

We want to make sure that your personal information is accurate and up to date. Please ask us to correct or remove any information you think is inaccurate.

The right to request erasure (also known as the right to be forgotten).

You have the right to ask for the deletion or removal of personal information where there is no compelling reason for it to be kept but, if the purposes for which the information was collected still exist, CPRA will be entitled to keep the information. Any request for erasure should be sent to the Secretary as below.

The right to complain.

If you are concerned about the way CPRA deals with your personal information you have the right to complain to the Information Commissioners Office. You can contact them by calling 0303 123 1113 or go online to ico.org.uk.

Neighbour Dispute Policy

From time to time, we are asked to assist in the resolution of disputes between neighbours. We have a longstanding policy that we cannot help in these situations; the reason being that we have no training, expertise, power nor resources enabling us to assist. Our usual suggestion is to seek legal advice, which we appreciate can be daunting.

Mediation may be a preferable alternative. Both parties need to agree and choose whether to be legally bound by the outcome. A mediator does not provide a judgement or final decision, but is there to work out a compromise and then follow up a few weeks later.

An audit by CEDR (see below) found that nearly three quarters of mediation cases are settled in one day with an 89% settlement rate. Procedures and cost vary, but these can be ascertained in advance and the process is much quicker and cheaper than going to court.
